After previous attempts by American victims of terrorism to sue the PLO-PA were blocked in the courts, the US Congress enacted the "Advancing Security and Justice for Victims of Terrorism Act", which states that an entity that pays terrorists who harm American citizens is considered to have consented to the jurisdiction of US courts.
The estate of Ari Fuld, an American-Israeli citizen who was murdered in 2018, filed a lawsuit based on this law.
Two days ago, on April 1, 2025, the US Supreme Court heard an appeal in this case, after an appeals court ruled that the law violates the Fifth Amendment to the Constitution.
The US Department of Justice expressed full support for the law, arguing that the PLO-PA received notice of Its implications, but they chose to continue with the payment policy.
Lt. Col. (res.) Attorney Morris Hirsch, a JCFA researcher, explains: "The ruling is expected soon, and if the Supreme Court upholds the constitutionality of the law, this could open the door to dozens of lawsuits against the PLO-PA in American courts, with the potential for compensation awards of hundreds of millions of dollars."
